Our client, Sally* came to us with a foreclosure case. She was struggling financially for several reasons, including the fact that she was paying for several stays in drug rehab for her son.

Consequently, she fell behind in her mortgage and went into foreclosure. Also during that time, sadly, she found her son dead in the house from an overdose. She went into deep depression and missed filing a deadline for her answer and the bank filed for default.

She came to us for assistance, and we filed to vacate the default and to ask for permission to late file her answer. Both were granted and we are in the process of assisting her to prevent the foreclosure.

Legal Services of the Hudson Valley's (LSHV) client, Sylvia* is the paternal grandmother of three children whose parents are heroin addicts who have each had several incarcerations.

LSHV represented the Sylvia in obtaining guardianship of the minor children after Child Protective Services became involved following the mother’s car accident with the youngest child in the car. The car accident occurred when the parents, both of whom were under the influence of heroin, had a domestic dispute in front the three minor children.

The mother took the youngest child from the home in the midst of the altercation and got into her car with the child and subsequently crashed less than a block from the home. LSHV’s efforts in obtaining guardianship kept the children out of the foster care system and they are thriving in the grandmother’s continued care.

Legal Services of the Hudson Valley's (LSHV) client Jenni’s* husband was physically abusive to her and had an alcohol and pill problem. Her husband was also an absentee father, and as a result of his drug use, contributed to a significant mental health issue for Jenni’s daughter as he would frequently appear and disappear from her life.

The husband was in Florida in a rehab center, and upon his discharge and return back to New York, LSHV served him with child custody and support petitions. Thereafter, the husband showed up at Jenni’s daughter’s gymnastics tournament impaired, yelling and trying to grab her, which led LSHV to file an Order of Protection in family court on behalf of Jenni.
